Law Enforcement Guidelines

These Guidelines are designed for all law enforcement agencies that request data from the Project about its Users and/or business partners.

Please note that answers to questions not related to the Law Enforcement Guidelines are not sent. In case of any other questions please contact our Customer Support Service.

Who is responsible for processing data disclosure requests?

The company TARMIN Eesti Trade OÜ, located in the Republic of Estonia, is the owner and operator of the Project as well as all of its mirror sites and applications. It processes all requests for the disclosure of the data of its Users and/or business partners around the world.

All data disclosure requests must be directed exclusively to TARMIN Eesti Trade OÜ even if TARMIN Eesti Trade OÜ has a local office in the country of location of the requesting law enforcement agencies. The company TARMIN Eesti Trade OÜ can only satisfy a request for data disclosure if it is obliged to do so in accordance with the legislation of the Republic of Estonia. Exceptions are possible in case of emergency.

The local offices of TARMIN Eesti Trade OÜ provide only internal support to their base company and have no right to disclose data at the request of law enforcement agencies. Besides, local offices of TARMIN Eesti Trade OÜ may not have access to all data that come through online services and Applications.

Information For Law Enforcement Agencies located in Estonia

Request for disclosure of (personal) data of Users and/or Business Partners

· must be legally binding for TARMIN Eesti Trade OÜ

· must be sent to the following postal address of TARMIN Eesti Trade OÜ: Kopli 81-11/12, 11712 Tallinn

Information For Law Enforcement Agencies located outside of the Republic of Estonia

Request for disclosure of (personal) data of Users and/or Business Partners

· must be sent the following postal address of TARMIN Eesti Trade OÜ: Kopli 81-11/12, 11712 Tallinn

· must be sent to the law enforcement of the Republic of Estonia as part of the judicial assistance procedure (under the Mutual Legal Assistance Treaty). If you have any questions, please contact your national centre or a centre for international legal assistance.

What must the data disclosure request contain?

TARMIN Eesti Trade OÜ discloses data only upon receiving a request that is legally binding in accordance with the legislation of the Republic of Estonia:

· the request must be addressed exclusively to TARMIN Eesti Trade OÜ, not to the Support Service, and written in an official style,

· the request must be clearly substantiated from a legal point of view,

· the request must contain a description of the natural person or legal entity whose data are requested,

· the request must contain the name and signature of the law enforcement officer, his official identification number, email address and direct contact telephone number,

· please indicate at least:

· email address or mobile phone number of the User (it is not enough to indicate only the User's full name),

· type and number of the identitification document of the User,

· brief description of the required data and the period for which the data are requested,

· expected response time.

Please be as precise as possible and remember that all data disclosure requests must be legitimate and consistent with the reason for appeal.

What happens in case of emergency?

TARMIN Eesti Trade OÜ may make exceptions to the normal data disclosure procedure if there is reason to believe that it is a case of emergency (for example, in the event of a terrorist attack, serious damage to or death of (threat of death to) a person) or may become such if data are not disclosed.

Emergency data disclosure requests:

· must be sent to the postal address of TARMIN Eesti Trade OÜ: Kopli 81-11/12, 11712 Tallinn

· must include a note regarding emergency (urgency),

· must include a description of the emergency (for example, damage to or death of a person),

· must (if possible) include a description of the persons under threat,

· must include a description of the necessary data and the reason why the disclosure of data by TARMIN Eesti Trade OÜ will help prevent an emergency (please be as precise as possible),

· must include all contact details and the signature of a law enforcement officer, including his direct telephone number.

Important Notes

· The Support Service of TARMIN Eesti Trade OÜ has no right to not disclose data by phone or email if this contradicts the above procedure.

· TARMIN Eesti Trade OÜ does not respond to letters sent to corporate/personal email addresses of its employees.

· TARMIN Eesti Trade OÜ responds to emergency requests only if they are sent according to the above procedure.

· TARMIN Eesti Trade OÜ protects payment details and banking data of its Users. Please take into account that credit cards data are usually hashed, therefore they cannot be read after 10 days as of the date of their direct use.

· TARMIN Eesti Trade OÜ reserves the right to notify its Users and/or business partners about any requests of their data being made by any third parties, unless such notice is prohibited by law.
